TERMS AND CONDITIONS

1.1 The MEANPROTEIN website is made for customers wishing to subscribe and/or purchase MEANPROTEIN products. When we refer to ‘us’ or ‘we’ this is in referral to MEANPROTEIN. The words ‘order’ and ‘subscribe’ are used interchangeably and refer to you purchasing a box which subsequently leads to you entering a recurring monthly or weekly order from us. The terms and conditions for which our products are sold are set out below in this document. By subscribing to us or buying a box, you both accept and are bound by these terms and conditions. You must consent to these terms of use to be able to purchase and gain information from the MEANPROTEIN website. These terms set out what the terms of subscription are and what you can and cannot do with the information provided by us. If you do not agree with these terms, you must leave our website immediately. We reserve the right to change these terms and conditions but any order or subscription that you have placed before the change will not be subject to the updated terms and conditions.

2. REGISTRATION & SUBSCRIPTION

2.1 By subscribing/buying you must:

• Be 18 years of age.

• Be legally able to enter contracts.

• Agree to us retaining your order information (including your name, age, email address, payment details and address). For more information, please see our PRIVACY POLICY.

2.2 Once we receive your order, we have the right to decline your offer. However, if we do accept your order, you will be billed for the amount relevant to your order. Once this money leaves your account, it is confirmed that we have accepted your order and your monthly or weekly subscription will commence.

2.3 We will take care, in so far as it is in our power to do so, to keep the details of your order and payment secure but in the absence and/or negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from the MEANPROTEIN website.

2.4 The prices within our website are in British Sterling and are inclusive of VAT. Shipping is an additional £3.00 per protein box.

2.4 Once you have subscribed and your first order is confirmed, you have entered a contact with MEANPROTEIN to receive a box that you purchased, every month or week and you will incur an automatic monthly or weekly subscription fee unless you cancel your subscription. Information on cancellation can be seen within section 5 of this document.

2.5 The price of the box will be billed to your account on the same day each month or on a weekly basis. This will be on a monthly or weekly basis after the day that you first subscribe. 

2.6 If you fail to pay on time, we will contact you regarding other forms of payment. If you fail to pay, your subscription will be cancelled. We reserve the right to take the steps necessary to collect the amounts due from you.

2.7 You are responsible for any extra fees charged to you by your bank or payment method, for example if you do not have the funds and go into your overdraft.

2.8 We reserve the right to change the price. When and/or if this occurs, we will notify you at least 30 days in advance of the change.

2.9 We will try to deliver your box within the first week of each month or on a weekly basis but we can not be held liable for any delays in delivery.

3. THE PRODUCT

3.1 Each month or week we select the brands and products that are supplied within the boxes. We have no obligation to include certain brands. The brands supplied will change or can remain the same each month.

3.2 Our products may contain gluten, milk/lactose, eggs, peanuts, nuts, celery, mustard, sesame seeds and soya or soybeans. Check the label of the product in the box to ensure the ingredients. We accept no liability for any damage caused by consumption if you failing to ensure the contents/ingredients of the products provided by us.

3.3 We accept no liability for the delivery of products where you have provided an inaccurate address.

3.4 If your order has been damaged during delivery, we accept no liability. If you see necessary, you will need to discuss this with the delivery company. Please also send us an email with a picture of the damage to meanprotein@yahoo.com and we can record this and may, at our discretion, offer a solution.

3.5 You may not resell the MEANPROTEIN box, and we accept no liability for any losses that may be incurred by you trading as a business accordingly, including loss of profit, loss of business, business interruption, or loss of business opportunity (given that the MEANPROTEIN boxes are intended for personal consumption).

3.6 Where you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of this agreement or our negligence but we are not responsible for any loss or damage that is not foreseeable. This does not affect your statutory rights.

4. RETURNS

4.1 Due to the nature of our products, unfortunately we can not accept returns.

5. CANCELLATION

5.1 In the case that you have recently begun your subscription, you have 14 days from the time and date of ordering in which to change your mind and cancel your subscription for a full refund. This may take up to 5 days to arrive into your bank account or if you paid with Paypal credit, the price of your purchase will be refunded into your Paypal account. If you box has already been sent, we ask you to return this to us. You must pay for the shipping fees.  

5.2 In the case that it is past these initial 14 days, you may cancel your subscription at any time by emailing us at meanprotein@yahoo.com but you will receive no refund for any payments already taken by us and your final box that you have paid for will be delivered within the first week of the month after cancellation. If you are on a weekly plan, if your weekly box has been sent, you will still be charged for this but at this point, your payments will be terminated. At this point you will be charged no further as your subscription will be terminated.

5.3 We have the right to cancel your subscription at any time for any reason.

6. THIRD PARTY PRODUCTS

6.1 For non MEANPROTEIN branded products (the products supplied within the boxes), where relevant, all warranty claims are to be made in accordance with the terms and conditions of any standard manufacturer’s warranty which may be included with the products purchased. In relation to any existing manufacturer’s warranty, any warranty claims should first be made either directly to the manufacturer or to MEANPROTEIN by email.

7. DATA POLICY

7.1 By using our website and purchasing from MEANPROTEIN, you agree to our terms of privacy which can be found within our PRIVACY POLICY within the footer of the website. We expect you to read these carefully.

8. WEBSITE USE

8.1 The MEANPROTEIN website will only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the MEANPROTEIN website and its use. You agree not to:

• Upload or transmit through any material which is defamatory, offensive or of an obscene character.

• Upload or transmit through the MEANPROTEIN website computer viruses or anything else designed to interfere with, disrupt or interrupt the normal operating procedures of a computer.

• Attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via any forms.

8.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Website will cease immediately.

8.3. MEANPROTEIN will not be liable for any loss or damage caused by any technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material.

8.4 You must not upload any information about anybody who is not yourself onto the MEANPROTEIN website or third party payment providers.

8.5. Information provided on the MEANPROTEIN website, including our blog posts, are for general knowledge only and we can not be held liable for any damage caused to you or any person who uses the information provided by us. We recommend you speak to a doctor or a professional, registered personal trainer or a nutritionist for information regarding diets, protein or any other topics covered by us.

9. REVIEWS

9.1 If you submit and/or post a review or any other form of media in relation to our products on the internet, we reserve the right to use this material for marketing purposes. You grant us a non-exclusive, royalty-free, perpetual and fully sub-licensable right to use, reproduce and modify such content throughout the world in any form of media.

10. AVAILABILITY

10.1 We will not be liable for any unavailability or failure, of this website or our services, or for any failure by us to comply with these Terms and Conditions, where such unavailability or failure arises from any cause reasonably beyond our control.

11. GIFT CARDS

11.1 Gift cards can be purchased via www.meanprotein.co.uk website only. 

11.2 Gift cards are redeemable at www.meanprotein.co.uk. 

11.3 Gift cards last for 60 months or five years. 

11.4 We are not responsible if any gift card is lost, stolen, destroyed or used without your permission.

11.5 We will have the right to close customer accounts and take payment from alternative forms of payment if a fraudulently obtained gift card is redeemed and/or used to make purchases.

11.6 In the event that Mean Protein closes, we are not liable to repay the balance of any unused gift card. This is up to our discretion.
